Condizioni di Vendita
Art. 1
Le Aste di Antiquariato Boetto S.r.l. (di seguito “Boetto”) organizza vendite all’asta al miglior offerente. I lotti sono posti in vendita in locali aperti al pubblico; Boetto agisce quale mandataria in esclusiva in nome proprio e per conto di ciascun cedente dei beni posti in vendita. Ogni compravendita si intende conclusa direttamente tra il cedente e l’aggiudicatario. Di conseguenza, Boetto non assume alcuna responsabilità diretta nei confronti degli acquirenti; ogni responsabilità, anche ai sensi degli artt. 1476 e ss. c.c., rimane in capo ai cedenti. Il colpo di martello del Direttore d’asta determina la conclusione del contratto di compravendita e l’obbligo dell’acquirente di corrispondere a Boetto l’intero importo dovuto (prezzo di aggiudicazione e diritti d’asta, cfr. art. 13). Il trasferimento della proprietà si perfezionerà esclusivamente a seguito dell’integrale versamento a Boetto di quanto dovuto (fatte salve le disposizioni del D.Lgs. n. 42/04; cfr. art. 15).
Art. 2
I lotti sono beni usati di carattere antiquariale, non qualificabili come “prodotti” ai sensi dell’art. 3, lett. e), del Codice del Consumo (D.Lgs. 206/2005).
Art. 3
L’asta sarà preceduta da un’esposizione pubblica, durante la quale Boetto fornirà chiarimenti e, su richiesta, condition report. L’esposizione consente l’esame diretto circa autenticità, stato conservativo, provenienza, tipologia e qualità dei lotti; ogni rischio e responsabilità ricade sugli offerenti/acquirente, anche ai sensi dell’art. 1488 c.c. Successivamente all’aggiudicazione, né Boetto né i cedenti potranno essere chiamati a rispondere per eventuali vizi dei lotti. Gli offerenti rinunciano espressamente alla garanzia di cui all’art. 1490 c.c. e sollevano Boetto da ogni correlata responsabilità. Chi partecipa all’asta si impegna a esaminare accuratamente i lotti prima della vendita, assumendo in proprio ogni rischio. In caso di aggiudicazione, il lotto si intenderà acquistato come visto e piaciuto. La presentazione di un’offerta vale quale dichiarazione di aver preso visione dei lotti e di accettarne incondizionatamente l’aggiudicazione nello stato di fatto e di diritto in cui si trovano.
Art. 4
I lotti sono venduti nelle condizioni in cui si trovano al momento dell’esposizione, con tutti i difetti presenti (rotture, restauri, mancanze, sostituzioni). Tali caratteristiche, anche ove non indicate in catalogo, non potranno fondare contestazioni. I beni di antiquariato possono essere stati restaurati o modificati (es. ridipinture): tali operazioni non costituiscono vizi occulti o falsificazione. I beni elettrici o meccanici non vengono verificati prima della vendita e sono acquistati a rischio dell’acquirente. I movimenti degli orologi sono da intendersi come non revisionati. Tutte le informazioni sui punzoni dei metalli, sulla caratura e il peso dell’oro, dei diamanti e delle pietre preziose colorate sono da considerarsi puramente indicative e approssimative e Aste Boetto non potrà essere ritenuta responsabile per eventuali errori contenuti nelle suddette informazioni e per le falsificazioni ad arte degli oggetti preziosi. Alcuni pesi in questo catalogo sono stati determinati tramite misurazioni. Questi dati devono considerarsi solo un’indicazione di massima e non dovrebbero essere acquisiti come esatti. Le informazioni relative a punzoni, caratura e peso di oro, diamanti e pietre di colore sono puramente indicative e approssimative. Boetto non garantisce i certificati eventualmente allegati ai preziosi, rilasciati da laboratori gemmologici indipendenti.
Art. 5
Boetto, quale mandataria, è esente da responsabilità in ordine alla provenienza e descrizione dei lotti nei cataloghi, condition report e ogni altro materiale illustrativo. Tali descrizioni sono di natura puramente indicativa e non vincolanti per Boetto. Boetto non rilascia garanzie in merito allo stato, attribuzione, autenticità o provenienza dei lotti, dei quali il cedente rimane l’unico garante. Laddove venissero accertate responsabilità in capo a Boetto, essa potrà rimborsare all’acquirente, previa restituzione del lotto contestato nel medesimo stato, il solo importo pagato (aggiudicazione e diritti d’asta) tutte le altre spese accessorie saranno a carico dell’acquirente.
Art. 6
Per i dipinti antichi e del XIX secolo viene certificata esclusivamente l’epoca dell’autore attribuito e la scuola di appartenenza. Le opere del XX e XXI secolo sono di regola corredate da certificati di autenticità indicati nelle schede. Nessun certificato o perizia richiesti successivamente alla vendita potrà essere invocato per contestare l’autenticità.
Art. 7
Per libri, manoscritti, stampe e altri beni cartacei, non si accettano contestazioni relative a danni alla rilegatura, macchie, fori di tarlo, carte rifilate, né per difetti che non pregiudichino la completezza del testo e/o dell’apparato illustrativo. In assenza della sigla “O.C.”, l’opera non è stata collazionata e non ne è garantita la completezza.
Art. 8
Qualsiasi contestazione dovrà essere presentata in forma scritta via raccomandata A/R entro il termine perentorio di quindici giorni dall’aggiudicazione; decorso tale termine, cessa ogni responsabilità di Boetto. In caso di contestazioni fondate su oggetti falsificati ad arte, purché l’acquirente restituisca il lotto libero da rivendicazioni di terzi e nelle stesse condizioni, Boetto potrà annullare la vendita e comunicare il nome del cedente. Boetto non procederà ad alcun rimborso se la descrizione era conforme all’opinione accettata da studiosi ed esperti alla data della vendita, ovvero indicasse come controversa l’autenticità, o se la contraffazione era accertabile solo mediante analisi difficilmente praticabili o di costo sproporzionato.
Art. 9
I lotti pervenuti all’organizzazione dopo la chiusura del catalogo saranno distinti con numeri bis.
Art. 10
Aste Boetto può accettare mandati per l’acquisto (offerte scritte e telefoniche), effettuando rilanci mediante il Banditore, in gara con il pubblico partecipante all’Asta. Boetto non potrà essere ritenuta in alcun modo responsabili per il mancato riscontro di offerte scritte, telefoniche, e via web, o per errori ed omissioni relative alle stesse. Con la richiesta telefonica Boetto prenderà contatto telefonico ai numeri indicati, al momento in cui verranno posti in vendita i lotti elencati. Con la richiesta telefonica si intende garantita da parte del cliente un’offerta al banco pari alla cifra minima presente sul catalogo per ogni lotto di suo interesse. Qualora per qualunque motivo, anche di natura tecnica, non riuscisse il contatto telefonico, la presente richiesta varrà come incarico per effettuare per conto del cliente offerte per l’acquisto dei lotti elencati fino al prezzo minimo indicato sul catalogo per ciascun lotto.
Art. 11
I lotti sono aggiudicati dal Direttore d’asta, il quale dispone della più ampia discrezionalità nella conduzione dell’asta. L’aggiudicazione avviene in favore del miglior offerente. In caso di contestazione, il lotto viene rimesso all’incanto nella stessa seduta. Boetto potrà non procedere all’aggiudicazione ove la migliore offerta non abbia raggiunto il prezzo di riserva. Il Direttore d’asta può ritirare un lotto, formulare offerte per il cedente fino al prezzo di riserva, abbinare o separare lotti o modificare l’ordine di vendita. In caso di parità tra offerta scritta e offerta in sala, si dà precedenza all’offerta in sala; tra offerte scritte, a quella pervenuta per prima. Qualora un’offerta da remoto pervenga in contestualità con il colpo di martello, il Direttore d’asta potrà a suo giudizio revocare la precedente aggiudicazione e procedere a una nuova.
Art. 12
Per partecipare, gli interessati dovranno compilare, sottoscrivere e consegnare l’apposita scheda di offerta (disponibile in catalogo, sul sito e in sede), allegando copia di un documento di identità in corso di validità. Con la sottoscrizione, i partecipanti si obbligano irrevocabilmente ad acquistare i lotti indicati e accettano le presenti Condizioni di Vendita. Il giorno dell’asta, prima dell’accesso in sala, i clienti dovranno richiedere il proprio “numero personale” previo rilascio delle generalità e copia del documento di identità; potranno essere richieste referenze bancarie o garanzie di pagamento. Boetto si riserva il diritto di negare l’ingresso e/o la partecipazione a chiunque, nonché di rifiutare offerte da soggetti non graditi (inclusi coloro che abbiano già partecipato ad aste di Boetto e abbiano tardatoo omesso pagamenti). A seguito di mancatoo ritardato pagamento, Boetto potrà rifiutare qualsiasi offerta nelle aste successive.
Art. 13
Per ogni lotto aggiudicato, l’aggiudicatario è tenuto a corrispondere a Boetto il prezzo di aggiudicazione nonché i diritti d’asta del 25% (comprensivi dell’IVA ove prevista per legge), oltre agli eventuali ulteriori oneri e spese previsti dalle presenti Condizioni.
Art. 14
L’acquirente dovrà completare il pagamento entro cinque giorni dall’aggiudicazione (termine sospeso nei casi di applicabilità del D.Lgs. n. 42/2004; cfr. art. 15) e ritirare i lotti entro due settimane. In caso di mancato pagamento, i lotti non saranno consegnati e Boetto potrà: a) risolvere l’aggiudicazione ex art. 1456 c.c. e restituire il bene al cedente, con penale pari ai diritti d’asta ex art. 13, salvo risarcimento del maggior danno; b) agire giudizialmente per l’esecuzione coattiva; c) vendere il lotto tramite trattativa privata o aste successive ex art. 1515 c.c., rivalendosi sul prezzo di vendita. Decorsi i termini senza adempimento, Boetto è esonerata da ogni responsabilità per perdita, danni o furti del lotto; l’aggiudicatario rinuncia a qualsiasi pretesa nei confronti di Boetto. Boetto avrà diritto al pagamento dei diritti di custodia, oltre a rimborsi per trasporto e magazzinaggio secondo le tariffe disponibili su richiesta. Su espressa richiesta dell’Aggiudicatario, le Aste Boetto potranno organizzare, a spese e rischio dell’Aggiudicatario, l’imballaggio, il trasporto e l’assicurazione dei lotti. Nonostante ogni disposizione contraria qui contenuta, Aste Boetto si riserva il diritto di concordare con gli Aggiudicatari forme speciali di pagamento, per le quali viene espressamente convenuto il patto di riservato dominio a favore di Aste di Antiquariato Boetto s.r.l. fino all’integrale e completa estinzione del debito. Resta pertanto inteso che il mancato o ritardato pagamento, anche di una parte soltanto delle rate stabilite, darà facoltà al venditore Aste di Antiquariato Boetto s.r.l. di ritenere risolta la vendita, di richiedere l’immediata restituzione del bene nel caso esso fosse già stato consegnato e di trattenere quanto già pagato a titolo di caparra confirmatoria.
Art. 15
Ciascun acquirente sarà tenuto, per i lotti soggetti a notifica ai sensi degli artt. 13 e ss. del D.Lgs. n. 42/2004 (Codice dei Beni Culturali) o al regime cautelare, all’osservanza di tutte le disposizioni applicabili, anche in materia doganale, valutaria e tributaria. È onere esclusivo dell’acquirente verificare le restrizioni alla circolazione e/o all’esportazione dei lotti e ottenere le licenze necessarie, con espresso esonero di Boetto. Boetto comunicherà i lotti in regime di temporanea importazione da parte di un cedente estero. In caso di esercizio del diritto di prelazione (artt. 60 e ss. D.Lgs. 42/2004) o acquisto coattivo (art. 70), l’aggiudicatario non potrà avanzare pretese nei confronti di Boetto e/o del cedente, fermi restando i diritti d’asta. I lotti già dichiarati di interesse culturale o in fase di procedimento saranno indicati in catalogo e/o annunciati dal Direttore d’asta. La vendita di lotti “notificati” è sospensivamente condizionata al mancato esercizio della prelazione ministeriale entro 60 giorni (o 180 giorni ex art. 61, co. 2, C.B.C.) dalla denuncia. L’eventuale dichiarazione d’interesse culturale sopravvenuta non inficia l’aggiudicazione né l’obbligo di pagamento. La spedizione all’estero è subordinata all’attestato di libera circolazione DVAL; l’ottenimento della documentazione è di esclusiva responsabilità dell’acquirente.
Art. 16
I clienti si impegnano a fornire copia del documento di identità e tutte le informazioni necessarie per consentire a Boetto di adempiere agli obblighi di adeguata verifica della clientela ai sensi dell’art. 22 del D.Lgs. n. 231/2007 (Antiriciclaggio). Il perfezionamento delle operazioni è subordinato al rilascio di tali informazioni. Ai sensi dell’art. 42 del medesimo decreto, Boetto si riserva la facoltà di astenersi dall’operazione in caso di impossibilità oggettiva di effettuare l’adeguata verifica.
Art. 17
Per lotti contenenti materiali di specie protette (corallo, avorio, tartaruga, coccodrillo, ossi di balena, corni di rinoceronte ecc.) è necessaria un’apposita licenza di esportazione CITES rilasciata dal Ministero dell’Ambiente. I potenziali acquirenti sono invitati a informarsi presso il Paese di destinazione sulla normativa applicabile.
Art. 18
Il diritto di seguito sarà posto a carico del cedente ai sensi dell’art. 152 della L. 633/1941, come sostituito dall’art. 10 del D.Lgs. 118/2006, ove applicabile.
Art. 19
Le stime in catalogo sono espresse in euro e hanno carattere meramente orientativo; non costituiscono garanzia alcuna e non possono ingenerare affidamento negli offerenti. Tali valori possono essere pari, superiori o inferiori ai prezzi di riserva concordati con i cedenti.
Art. 20
Le presenti Condizioni sono disciplinate dalla legge italiana e si intendono integralmente accettate da tutti i soggetti partecipanti alla vendita (anche da remoto, via telefono, via internet o mediante apposite applicazioni). In caso di traduzione, prevarranno le Condizioni nel testo in lingua italiana. Per qualsiasi controversia relativa all’attività di vendita all’asta presso Boetto, è stabilita la competenza esclusiva del Foro di Genova.
Art. 21
I dati forniti dai partecipanti sono trattati in conformità alla vigente normativa sulla protezione dei dati personali. Ai sensi dell’art. 13 del Regolamento UE n. 679/2016 (GDPR), Boetto informa che i dati saranno utilizzati per dare esecuzione agli obblighi contrattuali e ai contratti di compravendita, nonché per ogni altro servizio inerente all’oggetto sociale. Il conferimento dei dati è obbligatorio per l’esecuzione del contratto; per finalità ulteriori è facoltativo. Per l’informativa estesa si rimanda alla Privacy Policy su www.asteboetto.it. La registrazione alle aste consente a Boetto — salvo rinuncia — di inviare cataloghi e materiale informativo sulle aste successive.
Art. 22
Qualsiasi comunicazione inerente alla vendita dovrà essere effettuata tramite posta elettronica certificata o lettera raccomandata A/R indirizzata a: Aste di Antiquariato Boetto S.r.l. — Mura dello Zerbino 10R, Genova.
Condition of Sale
Art. 1
Aste di Antiquariato Boetto S.r.l. (hereinafter “Boetto”) organises sales by auction to the highest bidder. The lots are offered for sale on premises open to the public; Boetto acts as exclusive agent, in its own name and on behalf of each consignor of the goods offered for sale. Each sale is deemed to be concluded directly between the consignor and the successful bidder. Accordingly, Boetto assumes no direct liability towards buyers; all liability, including under Articles 1476 et seq. of the Italian Civil Code, remains with the consignors. The fall of the Auctioneer’s hammer marks the conclusion of the contract of sale and gives rise to the buyer’s obligation to pay Boetto the full amount due (hammer price and buyer’s premium; see Art. 13). Title shall pass only upon payment in full to Boetto of all sums due (without prejudice to the provisions of Legislative Decree No. 42/2004; see Art. 15).
Art. 2
The lots are second-hand goods of an antique nature, which do not qualify as “products” within the meaning of Article 3(e) of the Italian Consumer Code (Legislative Decree No. 206/2005).
Art. 3
The auction shall be preceded by a public viewing, during which Boetto will provide clarifications and, upon request, condition reports. The viewing allows the lots to be examined in person as to their authenticity, state of preservation, provenance, type and quality; all risk and responsibility lies with the bidders/buyer, including under Article 1488 of the Italian Civil Code. Once a lot has been knocked down, neither Boetto nor the consignors may be held liable for any defects in the lots. Bidders expressly waive the warranty provided for in Article 1490 of the Italian Civil Code and release Boetto from any related liability. Anyone taking part in the auction undertakes to examine the lots carefully before the sale and does so entirely at their own risk. Where a lot is knocked down to a bidder, it shall be deemed to have been purchased “as seen” (visto e piaciuto). The submission of a bid constitutes a declaration that the bidder has inspected the lots and unconditionally accepts their purchase in the factual and legal condition in which they stand.
Art. 4
Lots are sold in the condition in which they are found at the time of the viewing, with all existing faults (breakages, restorations, losses, replacements). Such characteristics, even where not mentioned in the catalogue, may not give rise to any claim. Antiques may have been restored or altered (e.g. overpainting): such interventions do not constitute hidden defects or forgery. Electrical or mechanical items are not tested before the sale and are purchased at the buyer’s risk. Watch and clock movements are to be regarded as not serviced. All information concerning hallmarks on metals and the carat and weight of gold, diamonds and coloured precious stones is to be regarded as purely indicative and approximate, and Aste Boetto may not be held liable for any errors in such information or for skilful forgeries of precious objects. Certain weights in this catalogue have been determined by measurement. These figures are to be regarded as a rough guide only and should not be relied upon as exact. Information concerning hallmarks, carat and weight of gold, diamonds and coloured stones is purely indicative and approximate. Boetto does not guarantee any certificates accompanying jewellery and precious objects that have been issued by independent gemmological laboratories.
Art. 5
As agent, Boetto bears no liability in respect of the provenance and description of the lots in catalogues, condition reports or any other illustrative material. Such descriptions are purely indicative and are not binding on Boetto. Boetto gives no warranty as to the condition, attribution, authenticity or provenance of the lots, for which the consignor remains solely answerable. Should any liability on the part of Boetto be established, Boetto may refund to the buyer, subject to the return of the disputed lot in the same condition, only the amount paid (hammer price and buyer’s premium); all other ancillary costs shall be borne by the buyer.
Art. 6
For Old Master and 19th-century paintings, only the period of the artist to whom the work is attributed and the school to which it belongs are certified. Works of the 20th and 21st centuries are as a rule accompanied by certificates of authenticity, as indicated in the lot descriptions. No certificate or expert opinion obtained after the sale may be relied upon to dispute authenticity.
Art. 7
For books, manuscripts, prints and other works on paper, no claims will be accepted in respect of damage to the binding, stains, wormholes or trimmed leaves, or for defects that do not affect the completeness of the text and/or the illustrations. In the absence of the abbreviation “O.C.”, the work has not been collated and its completeness is not guaranteed.
Art. 8
Any claim must be submitted in writing by registered letter with acknowledgement of receipt within the mandatory time limit of fifteen days from the fall of the hammer; once that time limit has expired, all liability on the part of Boetto shall cease. In the event of well-founded claims concerning skilfully forged objects, provided that the buyer returns the lot free from any third-party claims and in the same condition, Boetto may cancel the sale and disclose the name of the consignor. Boetto will make no refund if the description was in accordance with the opinion accepted by scholars and experts at the date of the sale, or indicated that the authenticity was disputed, or if the forgery could be established only by means of tests that are difficult to carry out or disproportionately expensive.
Art. 9
Lots received after the catalogue has closed will be identified by “bis” numbers.
Art. 10
Aste Boetto may accept commission bids (written and telephone bids) and will execute them through the Auctioneer, in competition with those attending the auction. Boetto may not be held liable in any way for failure to execute written, telephone or online bids, or for any errors or omissions relating to them. Where a telephone bid has been requested, Boetto will contact the client by telephone on the numbers provided when the listed lots come up for sale. By requesting a telephone bid, the client is deemed to guarantee a commission bid equal to the minimum price stated in the catalogue for each lot of interest. Should the telephone connection fail for any reason, including technical reasons, the request shall constitute an instruction to bid on the client’s behalf for the listed lots up to the minimum price stated in the catalogue for each lot.
Art. 11
Lots are knocked down by the Auctioneer, who has the widest discretion in the conduct of the auction. Lots are sold to the highest bidder. In the event of a dispute, the lot shall be re-offered during the same session. Boetto may decline to sell a lot where the highest bid has not reached the reserve price. The Auctioneer may withdraw a lot, place bids on behalf of the consignor up to the reserve price, combine or divide lots, or change the order of sale. Where a written bid and a bid in the room are for the same amount, the bid in the room shall take precedence; as between written bids, the one received first shall prevail. Should a remote bid be received at the same moment as the fall of the hammer, the Auctioneer may, at his or her discretion, revoke the previous sale and knock the lot down afresh.
Art. 12
In order to take part, interested parties must complete, sign and submit the bidding form (available in the catalogue, on the website and at Boetto’s premises), enclosing a copy of a valid identity document. By signing, participants irrevocably undertake to purchase the lots indicated and accept these Conditions of Sale. On the day of the auction, before entering the saleroom, clients must obtain their “personal bidding number” by providing their personal details and a copy of their identity document; bank references or payment guarantees may be requested. Boetto reserves the right to refuse admission and/or participation to anyone, and to reject bids from unwelcome persons (including those who have previously taken part in Boetto’s auctions and have delayed or failed to make payment). Following any failure or delay in payment, Boetto may refuse any bid at subsequent auctions.
Art. 13
For each lot purchased, the successful bidder shall pay Boetto the hammer price together with a buyer’s premium of 25% (inclusive of VAT where required by law), plus any further charges and expenses provided for in these Conditions.
Art. 14
The buyer must complete payment within five days of the fall of the hammer (this time limit being suspended where Legislative Decree No. 42/2004 applies; see Art. 15) and collect the lots within two weeks. In the event of non-payment, the lots will not be released and Boetto may: (a) terminate the sale pursuant to Article 1456 of the Italian Civil Code and return the item to the consignor, charging a penalty equal to the buyer’s premium under Art. 13, without prejudice to compensation for any further loss; (b) take legal action to enforce performance; (c) sell the lot by private treaty or at subsequent auctions pursuant to Article 1515 of the Italian Civil Code, recovering its claim from the sale proceeds. Once the time limits have expired without performance, Boetto is released from all liability for loss of, damage to or theft of the lot; the successful bidder waives any claim against Boetto. Boetto shall be entitled to payment of storage charges, as well as reimbursement of transport and warehousing costs at the rates available on request. At the express request of the successful bidder, Aste Boetto may arrange, at the successful bidder’s expense and risk, the packing, transport and insurance of the lots. Notwithstanding any provision to the contrary herein, Aste Boetto reserves the right to agree special terms of payment with successful bidders, in which case retention of title in favour of Aste di Antiquariato Boetto S.r.l. is expressly agreed until the debt has been discharged in full. It is therefore understood that failure or delay in payment, even of only part of the agreed instalments, shall entitle the seller, Aste di Antiquariato Boetto S.r.l., to treat the sale as terminated, to demand the immediate return of the item if it has already been delivered, and to retain the sums already paid by way of confirmatory deposit (caparra confirmatoria).
Art. 15
For lots subject to notification under Articles 13 et seq. of Legislative Decree No. 42/2004 (Italian Cultural Heritage Code) or to precautionary protection measures, each buyer shall comply with all applicable provisions, including customs, currency and tax regulations. It is the buyer’s sole responsibility to verify any restrictions on the movement and/or export of the lots and to obtain the necessary licences, Boetto being expressly released from any liability in this respect. Boetto will indicate those lots that are under temporary importation by a foreign consignor. In the event of the exercise of the right of pre-emption (Articles 60 et seq. of Legislative Decree No. 42/2004) or of compulsory purchase (Article 70), the successful bidder shall have no claim against Boetto and/or the consignor, without prejudice to the buyer’s premium. Lots already declared to be of cultural interest, or for which the relevant procedure is under way, will be indicated in the catalogue and/or announced by the Auctioneer. The sale of “notified” lots is subject to the condition precedent that the Ministry does not exercise its right of pre-emption within 60 days (or 180 days under Article 61(2) of the Cultural Heritage Code) of the notice of transfer. Any declaration of cultural interest made subsequently shall not affect the sale or the obligation to pay. Shipment abroad is subject to the certificate of free circulation (attestato di libera circolazione) DVAL; obtaining the documentation is the sole responsibility of the buyer.
Art. 16
Clients undertake to provide a copy of their identity document and all information necessary to enable Boetto to fulfil its customer due diligence obligations under Article 22 of Legislative Decree No. 231/2007 (Anti-Money Laundering). Completion of transactions is conditional upon such information being provided. Pursuant to Article 42 of the same Decree, Boetto reserves the right to refrain from carrying out the transaction where it is objectively impossible to perform customer due diligence.
Art. 17
For lots containing materials from protected species (coral, ivory, tortoiseshell, crocodile, whalebone, rhinoceros horn, etc.), a specific CITES export licence issued by the Italian Ministry of the Environment is required. Prospective buyers are advised to enquire in the country of destination about the applicable regulations.
Art. 18
The artist’s resale right (droit de suite) shall be borne by the consignor pursuant to Article 152 of Law No. 633/1941, as replaced by Article 10 of Legislative Decree No. 118/2006, where applicable.
Art. 19
The estimates in the catalogue are expressed in euros and are purely indicative; they do not constitute any guarantee and may not be relied upon by bidders. These figures may be equal to, higher than or lower than the reserve prices agreed with the consignors.
Art. 20
These Conditions are governed by Italian law and are deemed to be accepted in full by all persons taking part in the sale (including remotely, by telephone, via the internet or through dedicated applications). In the event of translation, the Italian text of the Conditions shall prevail. The Court of Genoa shall have exclusive jurisdiction over any dispute relating to auction sales conducted by Boetto.
Art. 21
The data provided by participants are processed in accordance with the data protection legislation in force. Pursuant to Article 13 of Regulation (EU) 2016/679 (GDPR), Boetto gives notice that the data will be used to perform contractual obligations and contracts of sale, as well as for any other service relating to its corporate purpose. The provision of data is mandatory for the performance of the contract; for other purposes it is optional. For the full privacy notice, please refer to the Privacy Policy at www.asteboetto.it. Registration for auctions allows Boetto — unless the client opts out — to send catalogues and information about forthcoming auctions.
